TERMS AND CONDITIONS OF ENTRY

1. TERMS

a. These Terms and Conditions of Entry (“Terms”) apply to all Entrants in the Promotion. This Promotion is promoted by Farmlands Co-operative Society Limited.

b. Defined terms in these Terms have the following meanings:

a. “Eligible Purchase” has the meaning given to that term in clause 2a.

b. “Entrant” means a person that satisfies the eligibility criteria set out in clause 2a.

c. “Farmlands Shareholder” means the primary account holder of a Farmlands Shareholder account.

d. “Promoter” means Farmlands Co-operative Society Limited, NZBN 9429042618577.

e. “Promotion” means the promotion described in these Terms.

f. “Promotion Period” means the period commencing at 9am on 1 July 2024 and ending at 5pm on 30 June 2025.

g. “Qualifying Product” means all Ballance fertilisers sold at Farmlands excluding gypsum, lime and dicalcic phosphate products.

h. The Promotion will run for the Promotion Period.

2. METHOD OF ENTRY, ELIGIBILITY:

a. To participate in the Promotion, Entrants must:

a. be a Farmlands Shareholder;

b. purchase and uplift 25 tonne or more of the Qualifying Product from Farmlands during the Promotion Period; (“Eligible Purchase”).

c. Make a purchase at Mitre 10 using your Farmlands card during the Promotion Period.

b. Each Entrant will receive:

a. $50.00 credit on their Farmlands Account for their purchase of the initial 25 tonne of Qualifying Product; and 

b. $2.00 credit on their Farmlands Account for each additional tonne of Qualifying Product purchased. 

c. Notwithstanding clause 2b above, the maximum credit payable by the Promoter to the participant’s Farmlands Account under the Promotion will be capped at $170.

d. Credit will be automatically added onto the Entrant’s Farmlands Statement in the month following the completion of an Eligible Purchase. 

e. The Promoter will not be liable for any failure to participate in the Promotion or to add credit to the Entrant’s Farmlands Account within the timeframe specified above due to technical problems or human error.

f. Example: If a shareholder purchases and uplifts 25 Tonnes or more of the Qualifying Products in July and purchases any product at Mitre 10 in the same month, he/she will receive $50 (incl. GST) of Mitre 10 credit on their Farmlands statement in August. 

g. The rewards are solely managed by the Promoter. 

h. At all times an Entrant’s entry into the Promotion is subject to approval from the Farmlands Credit and Risk Team, who will assess any risk or likelihood of the Entrant not making payment of their Farmlands account statement for the applicable month. The Farmlands Credit and Risk Team’s approval is at its sole discretion and it has the right to forfeit an Entrant’s entry into the Promotion and their eligibility to enter the Promotion. 

i. Employees of Farmlands who are Farmlands Shareholders are eligible to participate in this Promotion so long as all other eligibility criteria are satisfied. 

j. The Promoter reserves the right to request proof of an Entrant’s eligibility if there is a doubt over their eligibility for the promotion and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms.  

3. CREDIT REDEMPTION:

a. Credit can only be redeemed by making a purchase transaction at Mitre 10 by 31st July 2025. Credit cannot be exchanged, transferred or redeemed in cash.

b. The Entrant’s credit will appear on their next Farmlands account statement.

c. The credit, up to $170, can be accumulated across the Promotion Period. 

d. The Promoter may email the Entrants on a monthly basis with information relating to their eligible credit value that would be added to their Farmlands account/statement. 

e. Date range of processing uplifted fertiliser and Mitre10 transactions is 19th month to 20th month following. The first month will be 1st July – 18th July. This date range is subject to change by Farmlands from time to time but will always reflect a months' worth of sales.  

f. The Mitre 10 credit is capped at $300,000 over the 12 month period, and is subject to change at any time during the Promotion Period. 

4. MISCELLANEOUS:

a. The Promoter’s decisions on all matters relating to the Promotion will be final and no correspondence will be entered into. 

b. The Promoter may cancel, terminate, modify or suspend the Promotion or these Terms at any time and for any reason before the end of the Promotion Period and shall not be liable to any entrant for any loss or damage incurred as a result.

c. The Promoter takes no responsibility for omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction in respect of the Promotion and any resulting failure to record any eligible entries.

d. Except for liability that may not by law be excluded, the Promoter shall not be liable under or in connection with these Terms and/or this Promotion for any cost, expense, loss or damage suffered by any Entrant, even if such cost, expense, loss or damage was reasonably foreseeable, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

e. These Terms are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts. 

f. The Entrants consent, and waive all rights (including copyright and moral rights), to the Promoter using the entrants name, likeness, image and/or voice (including photograph, film, and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Promotion, and promoting any products manufactured, distributed and/or supplied by the Promoter. 

g. Entrants agree not to make any commercial or business use of the Promotion to resell or commercially benefit from any part or aspect of the Promotion.
