Sales Initiative Scheme 

Ballance & Farmlands Native Tree Initiative Terms and Conditions

Summary: Purchase selected Ballance fertiliser through your Farmlands Account and receive a free New Zealand native tree for every tonne of fertiliser purchased after the first 30 Tonnes.

1. Participation or electing to order Trees under this Initiative is deemed acceptance of these Terms and Conditions of Entry.Delivery will be in September 2023. 
2. The Initiative applies to purchases of Ballance fertiliser through Farmlands for the Initiative period. For every tonne of selected fertiliser products purchased after the first 30 tonnes, participants in the Initiative will be entitled to claim one specified New Zealand Native Tree (Tree). 
3. There is a maximum of 120 trees available per eligible Farmlands customer.
4. The Initiative participation period begins at 12.00 am on 1st February 2023 and ends at 11.59 pm on 31st May 2023 (“Initiative Period”).
5. The Initiative is provided by Farmlands Co-operative Society Limited of 535 Wairakei Road, Burnside, Christchurch 8053, New Zealand (“Farmlands”). 
   
   METHOD OF ENTRY, ELIGIBILITY
   
6. For the purpose of this Initiative, “Farmlands Shareholder” means the primary account holder of a Farmlands Shareholder account.
   The Initiative is open to Farmlands Shareholders who are New Zealand residents that Purchase the required quantities of selected Ballance fertiliser through their Farmlands Account (“Qualifying Account”) during the Initiative Period. The selected Ballance fertilisers are listed in the Product Schedule that forms part of these Terms and Conditions (“Qualifying Products”).
7. Farmlands Shareholders who meet the entry criteria (as determined by the Shareholder’s Farmlands account statement), will receive an email confirming their Qualifying Purchase. This email will include the process to order the tree(s) for delivery to a nominated Farmlands Branch. Deliveries of the Trees will be made to a nominated Farmlands Branch and must be collected within 7 days of the specified delivery date.
8. There are no warranties in respect of the Trees provided under the initiative.
9. At all times a Shareholder’s eligibility to participate in the Initiative is subject to approval from the Farmlands Credit and Risk Team, who will assess any risk or likelihood of the Shareholder not making payment of his or her Farmlands account statement for the applicable month. The Farmlands Credit and Risk Team’s approval is at its sole discretion, and it has the right to forfeit a Shareholder’s entry into the Initiative and that Shareholder’s eligibility to receive the Trees.
10. Employees of Farmlands or Ballance who are Farmlands Shareholders are eligible to participate in this Initiative so long as all other eligibility criteria is satisfied.
11. Every tonne of fertiliser purchased above 30 tonnes during the Initiative Period entitles the purchasing Shareholder to one selected New Zealand Native tree (for illustrative purposes only, if 33 tonnes are purchased, 3 trees will be provided). The list of native trees is attached with this Sales Initiative Scheme. The maximum number of Trees that may be redeemed per Shareholder is 120.
12. The Trees cannot be exchanged, transferred or redeemed for cash. 
13. The Trees are subject to availability and while stocks last. Stocks of certain Tree breeds or types may also be limited. Shareholders will be allocated Trees on a first-come, first-served basis. Final tree redemption is on 30th June 2023, unless availability runs out prior.
14. Farmlands’ decisions on all matters regarding the initiative will be final and no correspondence will be entered into.
15. Farmlands may cancel, terminate, modify or suspend the Initiative or these Terms and Conditions at any time and for any reason before the end of the Initiative Period and shall not be liable to any participant for any loss or damage incurred as a result.
16. Farmlands takes no responsibility for omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction in respect of the Initiative and any resulting failure to record any eligible entries.
17. Except for liability that may not by law be excluded, Farmlands shall not be liable under or in connection with these Terms and Conditions and/or this Initiative for any cost, expense, loss or damage suffered by any participant, even if such cost, expense, loss or damage was reasonably foreseeable, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
18. These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.
